Defending a Multi-Billion Naira Mining Project at the Federal High Court

A publicly listed mining company in the UK became involved in a high-value commercial dispute before the Federal High Court that threatened the viability of a major mining project. The litigation carried implications far beyond the courtroom, including project continuity, ESG rights, investor confidence, revenue generation and foreign stock market perception.

The opposing party was represented by Senior Counsel, increasing both the complexity and strategic importance of the proceedings and demanding a response that was as commercially considered as it was legally precise.

We approached the engagement as a commercial problem rather than simply litigation. Working closely with the client's leadership team, we developed the litigation strategy from inception, settled the pleadings, responded to contested interlocutory applications, and ensured that every procedural decision aligned with the client's broader commercial objectives and project timelines.

This was in addition to our exhaustive interpretation of the Mining Act, providing the court with the analytical foundation it required, alongside written and oral advocacy before the Federal High Court at every critical stage of the proceedings.

The client's legal position has been protected throughout the proceedings while allowing the underlying project to continue without disruption. Investor confidence and stock market perception, both cited as critical concerns at the outset, have been maintained.
